Terms and Conditions
1. All audio and written material is property of R’ Nivin’s Chaburas and cannot be used or reproduced by any person or company without explicit written consent from Devorah Handwerger, Rachel Horan, R’ Aryeh Nivin, or an official member of R’ Nivin’s Staff. Participants are absolutely forbidden from recording Chaburas in any scenario. Any unauthorized reproduction of audio or written material will be subject to legal action and is protected by Torah Law. It is forbidden according to Torah Law to copy or use recordings without permission in all cases, and (l’havdil) is forbidden according to international copyright law. Any questions as to the legality of reproduction should be directed to chaburapa@gmail.com.
2. This agreement is subject to Torah Law, and both parties agree that any dispute between R’ Nivin’s Chaburas and the participant will only be arbitrated by R’ Noam Roizman of Yerushalayim (currently a Dayan sitting on the Beis Din of R’ Nissim Karelitz). In the event of arbitration, both parties agree that the cost of arbitration and all other financial and legal issues will be conducted according to the conditions of the “Shtar Borerim” (שטר בוררים) of R’ Roizman.
3. By checking the box below, you are agreeing that you fully understand all of the above and below conditions, and you accept them upon yourself. Furthermore, you are agreeing to accept upon yourself the halachic rulings of the authorities (“Poskim”) who maintain that all written and audio material is considered genuine intellectual property and that R’ Nivin is the owner of all the audio and written material coming from his chaburas. By choosing to participate in R’ Nivin’s Chaburas, you are agreeing to pay for the whole course which will include 11-13 Chaburas, subject to the "3 Class Trial" stated below. The cost for a session of Chaburas is $150. New participants who choose to start the chabura with the “3-Class Trial” will not be billed the cost of the chabura if they email or call our staff before sunset of the "Cancellation Deadline". The Cancellation deadline for all February 2012 Chabura participants participating in the 3 Class Trial will be 2 days after the third class (Wednesay, February 22nd 2012). To be eligible for the 3 Class Trial, the participant is required to submit a valid credit card number, which will not be charged until the Cancellation Deadline has passed and no notification of intent to cancel has been received. If a new participant communicates to the Chabura Staff in writing or via telephone that they would like to opt out of the chabura before the cancellation deadline, their credit card will not be charged. From the time the Cancellation request has been received, the participant is no longer given permission to listen to the trial classes or to use the online info center - and the particpiant will no longer receive chabura communications. Once the cancellation deadline has passed and no communication has been received from the new participant enrolled in the 3 Class Trial, absolutely no refunds will be issued and all the standard terms and conditions mentioned for normal registrants and listed in this document will apply. New participants must explicitly request the 3 Class Trial via the application form, phone, or email at the time they register. There is no option to start the 3 Class Trial once normal registration for the Chabura has been processed.
R’ Nivin’s Chaburas and its staff members are hereby authorized to make the aforementioned payments on their appropriate dates with any credit cards on file for the participant.
4. Additional permission is granted to R’ Nivin’s Chaburas and its staff member to attempt to recharge credit cards on file in the event that any payment attempt fails; whether due to insufficient funds, erroneous card number, or any other reason. Both parties agree that the cost of the Chabura is legitimately owed to R’ Nivin’s Chaburas, and under no circumstance will either party be able to dispute the legitimacy of this debt, whether through credit card charge backs or through disputing the debt before a transaction has been made. Receipts issued by official employees of R’ Nivin’s Chaburas indicating payment of these debts shall be the only proof of a lack of a financial obligation. Subsequent attendance to the live Chabura calls or listening to recordings of the Chabura is not a condition for the legitimacy of this debt.
5. R’ Nivin’s staff will exert reasonable effort (through email communications to the email address on record for the participant) to make sure the Participant is always informed of the Chabura times, changes to schedules, and other important information. Failure to contact the participant about any change in schedule or time is not a basis to demand a refund. Payments for Chabura Sessions are absolutely non-refundable without exception. Payments for recordings are absolutely non-refundable without exception.
6. Participants who in the future will elect to participate in the “Automatic Registration Program” (Auto-Register) are hereby informed that payments of credit cards on file will be processed 2 weeks before the registration deadline of each subsequent session (“Auto-Registration Payment Date”). If a notification to cancel the automatic registration payment is not received by R’ Nivin’s staff members before 10am EST on the Auto-Registration Payment Date, then the payment will be processed. Refunds will not be given for processed payments; however, credits can be issued for future chaburas if the participant informs the staff before the start of the first class of the upcoming Chabura session that they would not like to participate in the upcoming Chabura even though they have already been charged. By emailing or calling a chabura Staff member and requesting to be signed up for Automatic Registration, the participant is hereby agreeing to all of the terms in this paragraph and all of the terms in this agreement, until they inform a Chabura staff member in writing regarding their request to be removed from the automatic payment schedule. Current participants that register late for additional sessions (late is defined as after the designated Registration Deadline which will be communicated via email) will be assessed a $25 administrative fee to cover the cost of extra administrative efforts.
